What Anpa is
Anpa is early-access, business-to-business software for running course and coaching programs — registration, payments, live classes, audience segmentation, and lifecycle email and SMS in one system. These terms govern your organization's ("you") use of Anpa during early access, starting from when we grant your account.
Because Anpa is in early access, features, pricing, and these terms may change as the product matures. We'll tell you about material changes before they affect your account.
Acceptable use
You agree to use Anpa only for legitimate course and coaching program operations, and not to:
- Use Anpa to send unsolicited bulk messages, or messages to contacts who haven't consented to receive them.
- Upload or process data you don't have the right to use, including contact lists obtained without consent.
- Attempt to interfere with, disable, or gain unauthorized access to Anpa's systems or other customers' data.
- Use Anpa to violate any applicable law, including data protection, telemarketing, and anti-spam law.
- Resell or provide Anpa to third parties as a standalone service without our agreement.
We may suspend or terminate access for use that violates this section, particularly anything that risks our email and SMS sending reputation or another customer's data.
Fees
Anpa does not have public, self-serve pricing during early access. Any fees are as separately agreed in writing between you and Anpa before your account is activated, and will be set out in an order form, invoice, or similar written agreement referencing these terms.
Your data
You own the data you put into Anpa — your contacts, enrollment records, payment history, and message content. We process it to provide the service, as described in our Privacy Policy. You're responsible for having the right to collect and use the data you upload, including consent for any marketing email or SMS you send through Anpa.
Warranty disclaimer
Anpa is provided "as is" during early access. We work to keep it reliable and accurate, but we don't warrant that it will be uninterrupted, error-free, or fit for a particular purpose beyond what we describe in writing. To the extent permitted by law, we disclaim all other warranties, express or implied.
Limitation of liability
To the extent permitted by law, Anpa's total liability arising out of or related to these terms or your use of Anpa will not exceed the amount you paid us in the twelve (12) months before the claim arose. Neither party is liable for indirect, incidental, or consequential damages, including lost profits or lost data, except where that limitation isn't permitted by law.
Termination and data export
Either party may terminate the relationship at any time, for any reason, by written notice. If we terminate your account for reasons other than a violation of these terms, or if you terminate, we'll give you a reasonable window — at least 30 days — to export your data (contacts, enrollment and payment history, and message logs) in a usable format before it's deleted from our systems.
Governing law
These terms are governed by the laws of the U.S. state in which Anpa's operator resides, without regard to conflict-of-law principles. The specific state will be named in your countersigned early-access agreement.
Changes to these terms
As an early-access product, we may update these terms as Anpa develops. We'll update the effective date above and, for material changes, notify active customers before the change takes effect.
